Section 504 Information
Upon receipt of a 504 referral, the 504 team will meet to determine whether your student is eligible for services under Section 504 of the Rehabilitation Act of 1973. This meeting is necessary to determine the most appropriate school program for your student.
NHV Section 504 Eligibility Guidelines
Section 504 only applies to persons considered to have a disability as defined in the Section 504. As a result, the question of eligibility is a critical issue. According to the law, the NHV 504 team has sole authority to determine eligibility. When determining the eligibility of individuals for Section 504 protections and services, the following questions must be addressed by the NHV 504 Committee:
- Does the student have a physical or mental impairment?
- If so, does it impair a major life activity?
- Examples of life activities include but are not limited to: seeing, hearing, speaking, walking, learning, performing manual tasks, breathing, writing, lifting, reading, thinking, concentrating, sleeping, eating, bending, reaching, interacting with others, speaking, bowel functions, bladder functions, digestive functions, immune system functions, circulatory system functions, endocrine system functions
- If so, is the degree of impairment substantial?
- Degree of impact must be considered in reference to the average student of a similar age without any mitigating factors.
